THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

McNeil Psychiatric Services & Consulting, LLC (“McNeil Psychiatric Services,” “we,” “our,” or “the Practice”) is committed to protecting the privacy and confidentiality of your health information.

This Notice of Privacy Practices (“Notice”) describes how we may use and disclose your Protected Health Information (“PHI”), your rights regarding your health information, and our responsibilities under applicable federal and state privacy laws.

Your Rights

When it comes to your health information, you have certain rights.

Get a Copy of Your Medical Record

You may request to see or obtain an electronic or paper copy of your medical record and other health information we maintain about you.

We will generally provide a copy or summary of your health information within the timeframe required by law. We may charge a reasonable, cost-based fee when permitted by law.

Ask Us to Correct Your Medical Record

If you believe health information in your medical record is incorrect or incomplete, you may ask us to amend or correct it.

We may deny your request in certain circumstances, but if we do, we will explain the reason to you in writing as required by law.

Request Confidential Communications

You may ask us to communicate with you in a specific way or at a particular telephone number, email address, or mailing address.

We will accommodate reasonable requests.

Because McNeil Psychiatric Services provides telehealth services, please make sure the Practice has current and accurate contact information and inform us if there are methods of communication you do not want us to use.

Ask Us to Limit What We Use or Share

You may ask us not to use or disclose certain health information for treatment, payment, or healthcare operations.

We are generally not required to agree to all requested restrictions.

However, if you pay for a healthcare service or item completely out-of-pocket, you may ask us not to disclose information about that service to your health plan for payment or healthcare operations. We will honor that request unless disclosure is required by law.

Get a List of Certain Disclosures

You may request an accounting of certain disclosures of your health information made during the six years before your request.

The accounting generally will not include disclosures made for treatment, payment, healthcare operations, or certain other disclosures excluded by law.

We will provide one accounting within a 12-month period at no charge. We may charge a reasonable, cost-based fee for additional requests when permitted by law.

Get a Copy of This Notice

You may request a paper or electronic copy of this Notice at any time, even if you previously agreed to receive it electronically.

Choose Someone to Act for You

If you have given someone medical power of attorney or another person is legally authorized to act as your personal representative, that individual may exercise your privacy rights on your behalf.

We may verify the individual’s legal authority before taking action.

Special rules may apply to parents, guardians, minors, and other personal representatives under applicable federal and state law.

These situations may include:

If you are unable to tell us your preference—for example, because you are unconscious or experiencing an emergency—we may share information when we determine that doing so is in your best interest and is permitted by law.

We may also disclose information when necessary to reduce a serious and imminent threat to your health or safety or the health or safety of another person, as permitted by law.

Mental Health Information

Because we provide psychiatric and mental-health services, your records may contain particularly sensitive information.

We will comply with applicable federal and state laws that provide additional protections for mental-health information.

Psychotherapy Notes

Psychotherapy notes receive additional protections under HIPAA. When applicable, we generally will not use or disclose psychotherapy notes without your written authorization except when specifically permitted or required by law.

Marketing and Sale of Information

We will obtain your written authorization before using or disclosing your PHI for purposes that require authorization under HIPAA, including certain marketing activities.

McNeil Psychiatric Services does not sell your Protected Health Information.

How We May Use and Disclose Your Information

We typically use or disclose health information in the following ways.

Treatment

We may use and disclose your health information to provide, coordinate, and manage your healthcare.

For example, we may share relevant information with another healthcare professional involved in your treatment, such as your primary care physician, therapist, pharmacy, laboratory, specialist, or another treating provider when permitted by law.

Payment

We may use and disclose health information to bill and obtain payment for services.

For example, we may provide necessary information to your health insurance company to determine eligibility, obtain authorization, submit a claim, or receive payment for services.

Healthcare Operations

We may use and disclose health information to operate our Practice and improve the quality of care we provide.

Examples may include:

We may disclose information to authorized health-oversight agencies for activities permitted by law, such as audits, investigations, inspections, licensing, and disciplinary proceedings.

Records protected by Part 2 generally may not be used or disclosed in civil, criminal, administrative, or legislative proceedings against a patient unless specifically authorized by the patient or permitted by a court order or other applicable law.

We will obtain patient consent for uses or disclosures of Part 2 records when consent is required.

Electronic Health Information and Telehealth

McNeil Psychiatric Services provides services through telehealth and utilizes electronic systems to maintain medical records, communicate with patients, coordinate treatment, process payments, and conduct other healthcare activities.

We maintain administrative, technical, and physical safeguards designed to protect your electronic Protected Health Information.

Our Practice may use qualified third-party service providers to assist with functions such as electronic health records, telehealth, billing, scheduling, secure communications, prescription processing, and other healthcare operations. When required by HIPAA, these organizations are considered Business Associates and are contractually required to appropriately safeguard PHI.

Our Responsibilities

McNeil Psychiatric Services is required by law to:

We will not use or disclose your health information for purposes not described in this Notice unless you provide written authorization or the use or disclosure is otherwise permitted or required by law.

If you provide written authorization, you generally may revoke that authorization in writing at any time. Revocation will not affect actions we already took in reliance on your authorization.

Additional Privacy Protections

Certain categories of health information may receive additional protection under federal or state law.

These may include information involving:
